KWA argues on behalf of Kentuckians and the environment in U.S. Federal Court

On Thursday, August 2, KWA went to federal appeals court in our ongoing effort to protect Herrington Lake from the selenium, arsenic, and other pollutants leaking from the Kentucky Utilities EW Brown power plant coal ash ponds. The unlined 50-year old disposal ponds have been proven to leak and we can see where the water enters the lake. Testing has found fish with deformities and levels of selenium above state limits. However, the current Corrective Action Plan calls for years of study. We and our partners in the suit, Kentucky Sierra Club, say no – we know what the problem is and how to fix it – let’s get to work. Earthjustice attorneys did a fine job presenting our case and rebutting the KU arguments. The decision will come down in a few months.
